Terms of Service

Use of our service, whether directly or indirectly, constitutes your acceptance of these terms and agreement to abide by them. We reserve the right to amend or adjust these terms at any time. Your continued use of our services constitutes your acceptance of any changes we make. We reserve the right to terminate any account without warning or notice if any of the above restrictions or if our Acceptable Use Policy is violated, with no refund, and to examine the contents of any account at any time.

Illegal Use

You may not use your service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America as well as the laws of Amsterdam and the Netherlands. Violations of this provision may result in us making your information and information about your service and it's use available to law enforcement with or without your consent or knowledge.

Liability

You are solely and fully responsible for the contents of your account. Any and all repercussions will be borne solely by you as the account holder.

In no event will SiteTrec be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use SiteTrec' services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.

We are not liable for any damage or loss of data due to insufficient cooling, heating, bandwidth or acts of God.

Refunds

Due to the nature of our industry, we only offer 14 day money back guarantee refunds from the first invoice on your account. This is only acceptable for new customers only. 14 day back guarantee does not follow through with any other invoices. Domains are not applicable to refunds. If a free domain is included in the sale of the service we will deduct $15.00 USD from the refund.

Billing

Service disconnects generally begin once the invoice is 3 days past due, but depends of the age of your account and whether you maintain good communication with SiteTrec. After 30 days of suspension data will be stored for up-to 30 days. After this period all data will be removed permanently with no restore point.

Scope of Support

Our support is lenient and may assist with queries at their own discretion. However, our typical scope of support goes as follows:

Shared Website Hosting:

  • DNS configuration
  • Extension/Package installation
  • PHP/Apache modifications
  • .htaccess modifications
  • CloudFlare Deployment Installs
  • Minor code assistance (errors displayed on web page)
  • Network and Service availability (if the product is having technical issues on our behalf)

  • Virtual Private Servers:

  • Network and Service availability (if the product is having technical issues on our behalf)
  • Hardware maintenance/checks
  • Bare minimal OS assistance
  • IPMI

    Our IPMI web interfaces are publicly accessible. SiteTrec may not be held responsible for any loss of data or service or any other damage caused by a security breach. It is also forbidden to change the password of other accounts that were configured.

    Semi-Managed Addon

    Our Semi-Managed addon offers limited support with software configuration and installation. The service is frequently monitored by our team for abnormal resource changes and/or network activity. A dedicated account specialist is available Mon-Fri from 7:00 AM GMT-7 until 2:30 PM GMT-7. Response time average is an hour. May or may not assist with queries outside of our normal scope of support.

    Fully Managed Addon

    We will offer our best effort with code assistance, such as errors in pre-existing code. We will not write any new code. We offer best effort support with software configuration and installation. A dedicated account specialist is available Mon-Fri from 7:00 AM GMT-7 until 2:30PM GMT-7. Response time average is 45 minutes. Will provide best effort to assist with queries outside of our normal scope of support.

    Processing Fee

    SiteTrec will automatically add a processing fee to orders and invoices for services. This process fee is currently set to 3% of the order total. For example, for a $10.00 invoice you will have a processing fee of 3% which will be $0.3. This would make the total invoice amount for $10.30.

    Acceptable Use Policy

    This Acceptable Use policy document, including the following list of prohibited Activities, is an integral part of your Hosting Agreement with SiteTrec. If you engage in any of the activities prohibited by this AUP document SiteTrec, may suspend or terminate your account and may result in criminal and civil liability. SiteTrec, will investigate incidents involving such violations and may involve and will cooperate with law enforcement and Wholesale Internet, Inc. if a criminal violation is suspected.

    SiteTrec Acceptable Use policy (the "policy") for SiteTrec Services is designed to help protect SiteTrec, SiteTrec customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The policy is a non-exclusive list of the actions prohibited by SiteTrec. SiteTrec, reserves the right to modify the policy at any time, effective upon posting here.

    Examples of SiteTrec system or network security violations include, without limitation, the following:

  • Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
  • Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through SiteTrec' servers is prohibited. Likewise, the sending of UBE from another service provider advertising a website, email address or utilizing any resource hosted on SiteTrec' servers is prohibited. SiteTrec' accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
  • Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by SiteTrec customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any SiteTrec-hosted domain, or referencing any SiteTrec account, is prohibited.
  • Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
  • Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso.
  • Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
  • Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
  • Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any SiteTrec customers or end-users by any means or device.
  • Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the SiteTrec network or on another provider's network.
  • Using SiteTrec,' services to interfere with the use of the SiteTrec, network by other customers or authorized users.
  • Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
  • INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A SITETREC HOSTING, LLC CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

    Customer Responsibility for Customer's Users

    Each SiteTrec customer is responsible for the activities of its users and, by accepting service from SiteTrec, is agreeing to ensure that its customers/representatives or end-users abide by this policy. Complaints about customers/representatives or end-users of any SiteTrec, customer will be forwarded to the SiteTrec, customer's postmaster for action. If violations of the SiteTrec, Acceptable Use Policy occur, SiteTrec, reserves the right to terminate services with or take action to stop the offending customer from violating SiteTrec,' AUP as SiteTrec, deems appropriate, without notice.

    Privacy Policy

    We SiteTrec (SiteTrec.com), are committed to protecting any data that we collect concerning you. By using our services you agree to the use of the data that we collect in accordance with this Privacy Policy.

    We collect the minimum amount of information about you that is commensurate with providing you with a satisfactory service.     Information Collected

    We may collect any or all of the information that via both automated means such as communications profiles and cookies. Personal Information you give us depends on the type of service, support, or sale inquiry, and may include your name, address, telephone number, fax number and email address, dates of service provided, types of service provided, payment history, manner of payment, amount of payments, date of payments, domain name or other payment information. All sensitive information is collected on a secure server and data is transferred . When transferring personal information a security icon will appear in your browser.

    Information Use

    This information is used for billing and to provide service and support to our customers. We may also study this information to determine our customers needs and provide support for our customers. All reasonable precautions are taken to prevent unauthorised access to this information. This safeguard may require you to provide additional forms of identity should you wish to obtain information about your account details. SiteTrec may email its monthly newsletter to the primary contact e-mail on file, but customers are able to opt out of this newsletter at any time.

    Log Files

    We use IP addresses to analyze trends, administer our site and servers, track access, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. It is possible that personal information about a customer may be included in the log files due to the normal functions of IP addresses and Web browsing.

    Cookies

    Your Internet browser has the in-built facility for storing small text files - "cookies" - that hold information which allows a website to recognize your account. We use cookies to save your preferences and login information, and provide personalized functionality. You can reject cookies by changing your browser settings, but be aware that this will disable some of the functionality on the SiteTrec's .
